Pour-over wills and trust coordination

A pour-over will and a revocable living trust are two pages of one fact set. The will names the trust. The trust names the same person and the same date. When those strings drift — “Smith Family Trust” on one page and “The Smith Trust dated January 15” on the other — the record disagrees with itself.

What usually goes wrong

• Two name spellings — testator on the will is not the trustmaker on the trust.
• Two trust titles — the will pours into a name the trust instrument never uses.
• Two dates — will date and trust date are different facts with no seal.
• Old will language on a new trust — “I hereby give, devise and bequeath” next to a present-tense trust catalog.

Before (mismatched pair)

WILL: I hereby give, devise and bequeath the residue to the Smith Family Trust.
TRUST: FOR THE REVOCABLE-LIVING-TRUST … TRUST-NAME: THE J. SMITH LIVING TRUST OF THE DATE JANUARY 15, 2025.

After (one fact set in both templates)

TRUST ~1: TRUST-NAME: [TRUST-NAME].
TRUST ~2: TRUST-DATE: [DATE].
WILL ~2: TRUST: [TRUST-NAME] OF THE DATE [DATE].
WILL ~3: WITH THE RESIDUAL-ESTATE IS FOR THE TRANSFER TO THE TRUST IS WITH THE RECORD.

Fill the same [TRUST-NAME], [DATE], and person name on both loads. Prefer a sealed date such as ~15~JANUARY~2025~ in both documents.

Templates to load

• REVOCABLE-LIVING-TRUST-SHORT-FORM — trust name, date, trustmakers, trustee.
• POUR-OVER-WILL-SHORT-FORM — testator, same trust name and date, residual estate to the trust, executor.

How to run it

1. Write the shared facts once: person name, [TRUST-NAME], [DATE], executor / trustee names.
2. Load the trust: processor · revocable living trust (short). Fill those brackets. ANALYZE.
